SC: SPECIAL LEAVE PETITION FILED AGAINST ONLY A REVIEW ORDER WOULDNT BE MAINTAINABLE

Justice Sanjay Kishan Kaul and Justice M. M. Sundresh of the top court noted that special leave petition that had been filed against only a review order wouldn’t be maintainable and the court dismissed the same.The petitioner had already filed a special leave petition before the Supreme Court and the court dismissed it which led the petitioner to file a review application before the top court wherein the court had dismissed it. Thus, the present special leave petition.

Another special leave petition was filed before the Apex Court, the court noted and remarked:

Be that as it may, now it is not possible for the petitioner to assail only the review order and a Special Leave Petition against only a review order would not be maintainable in view of the judgment of this Court in Municipal Corporation of Delhi Vs. Yashwant Singh Negi – (2020) 9 SCC 815 and the fact remains that the petitioner cannot challenge the substantive order as the Special Leave Petition against the same was even earlier dismissed.”
